Terms of Service

The standard operating terms under which Altida Dinamik Maritime quotes, dispatches and audits freight movements — read alongside the signed engagement document.

Acceptance

These Terms govern your use of this website and any engagement with Altida Dinamik Maritime Sdn Bhd(“Altida”), a freight forwarder and Class 1 dangerous-goods logistics operator incorporated in Malaysia. By submitting a quotation request, signing an engagement document, or instructing a movement, you confirm acceptance of these Terms alongside the commercial document executed for that engagement.

Where these Terms conflict with a signed engagement document, the engagement document prevails.

Scope of services

Altida provides Class 1 dangerous-goods logistics, oil & gas project freight, integrated technical services and bonded warehousing & transit-hub operations. The exact scope, lane, vessel, mode and milestones for each movement are defined in the engagement document. Anything outside the engagement document is out of scope unless expressly agreed in writing.

Quotations and contracts

  • Quotations are valid for the period stated on the quote (default 14 days) and assume the cargo description, weights and dimensions supplied by the shipper are accurate.
  • Class 1 quotations are conditional on PDRM permit availability and route clearance.
  • A binding contract arises only when an engagement document is countersigned, or a movement is dispatched against an instruction we have accepted in writing.

Shipper obligations — hazardous goods

The shipper is responsible for declaring the full and accurate nature of the cargo, including UN number, proper shipping name, class, packing group, net explosive quantity, compatibility group, packaging certification, and any special handling requirements.

Misdeclared dangerous goods — including hidden DG — may result in immediate stop-movement, regulatory disclosure, civil liability under Malaysian law, and recovery of all costs including demurrage, detention, port fines and salvage.

Documentation and customs

The shipper warrants that all customs, export-control and commercial documentation is accurate, complete and supplied in time for the planned movement. Altida acts as the appointed forwarder and is not liable for delay, seizure or fines arising from documentation supplied late or in error by the shipper or consignee.

Payment

  • Charges are payable in MYR (or as agreed in the engagement document).
  • Invoices are due within thirty (30) days of issue unless a shorter period is required by the underlying carrier or magazine operator.
  • Late payments may accrue interest at one and a half percent (1.5%) per month, and may trigger a hold on undelivered cargo, subject to lien rights below.

Lien

Altida holds a general and particular lien over cargo, documents and proceeds in respect of all sums due — whether for the current movement or any earlier engagement. The lien may be exercised in accordance with applicable Malaysian carriage and warehousing law.

Insurance

Altida maintains carrier's and warehousekeeper's liability cover appropriate to the licensed scope of operations. Cargo insurance is the shipper's responsibility unless expressly arranged by Altida and noted in the engagement document. Marine, aviation and inland transit cover may be procured at the shipper's instruction at additional cost.

Liability

  • Altida's liability for loss, damage or delay is governed by the carriage regime applicable to the relevant leg — Hague-Visby, Montreal Convention, CMR equivalents or the local domestic carriage regime — as adopted in the engagement document.
  • Indirect, consequential, loss-of-profit and loss-of-business damages are excluded.
  • Total liability for any one movement is capped at the lower of (a) the carriage regime ceiling, or (b) the freight charged for that movement, unless a higher declared value has been agreed in writing.

Compliance and HSSE

Movements are executed against Altida's ISO 9001 quality and ISO 45001 OH&S management systems, the IMDG Code, IATA Dangerous Goods Regulations, API RP 67 for oilfield explosives handling, and PDRM permit conditions. The shipper agrees to co-operate with HSSE pre-movement checks, toolbox briefings and incident reporting protocols.

Force majeure

Neither party is liable for failure or delay arising from events beyond reasonable control, including: regulatory action; permit suspension; port, airport or border closures; armed conflict; severe weather and sea-state; pandemic-related restrictions; or industrial action. Affected parties will mitigate and resume as soon as practicable.

Confidentiality

Commercial information exchanged in the course of an engagement — rates, cargo descriptions, manifests, project briefs — is confidential and may only be disclosed to regulators, sub-carriers and professional advisers on a need-to-know basis, or as required by Malaysian law.

Governing law and disputes

These Terms and any engagement document are governed by the laws of Malaysia. The parties submit to the exclusive jurisdiction of the courts of Malaysia. Arbitration under the AIAC Arbitration Rules may be elected by mutual agreement in the engagement document.

Changes

Altida may update these Terms from time to time. The effective date above will move forward when material changes are made. Existing engagement documents remain on the Terms in force at signature.
